{"id":3050,"date":"2021-05-07T12:22:00","date_gmt":"2021-05-07T12:22:00","guid":{"rendered":"http:\/\/paju.org\/?p=3050"},"modified":"2021-05-16T10:11:06","modified_gmt":"2021-05-16T10:11:06","slug":"end-of-occupation-no-1056","status":"publish","type":"post","link":"https:\/\/paju.org\/fr\/end-of-occupation-no-1056\/","title":{"rendered":"End of Occupation \u00bb No 1056"},"content":{"rendered":"<p>Israeli Human Rights NGOs Demand Prosecution of IDF Colonel and Physician for Raping Palestinian Woman<\/p>\n<p><strong>Richard Silverstein April 25, 2021<\/strong><\/p>\n<p>My last post\u00a0<a href=\"https:\/\/www.richardsilverstein.com\/2021\/04\/23\/breaking-idf-commander-who-ordered-rape-of-palestinian-identified\/\">identified<\/a>\u00a0the senior IDF officer responsible for the rape of a Palestinian female detainee in 2015.\u00a0 He is\u00a0<strong>Col. Yariv Ben Ezra<\/strong>, then commander of the Hebron Brigade and now defense attache in South Korea.\u00a0 Ben Ezra ordered a battalion commander <img loading=\"lazy\" decoding=\"async\" class=\" wp-image-3047 alignright\" src=\"http:\/\/paju.org\/wp-content\/uploads\/2021\/05\/1056.jpg\" alt=\"\" width=\"150\" height=\"145\" \/>to conduct an invasive full-body search of the vagina and anus of a young Palestinian woman suspected of being in some way associated with Hamas.\u00a0 The battalion commander then directed a female doctor and another female soldier to conduct the sexual assault on the victim, who protested vehemently against her abuse.\u00a0\u00a0The entire operation was originally devised by a Shin Bet district coordinator, \u201cYossi,\u201d who ordered an \u201cintimate\u201d search of the woman.<\/p>\n<p>Previously,\u00a0 they had interrogated the woman and not discovered any useful intelligence. But Yossi determined that they needed to find her SIM card to discover if she had been communicating with any Hamas operatives.<\/p>\n<p>Soldiers ransacked her house and bedroom without finding the card.\u00a0 That\u2019s when Yossi told the IDF to engage in an act of sexual assault.<!--more--><\/p>\n<p>The only reason this case was investigated at all was due to the perseverance of Jana Modzgvrishvily, a former IDF prosecutor General, who worked as a justice ministry prosecutor for police internal affairs. Despite the opposition of her colleagues in the ministry, she cajoled them into agreeing to open a case.\u00a0 She also persuaded the Palestinian woman to file the complaint that led to the investigation.<\/p>\n<p>But Modzgvrishvily lost out in the running for the top prosecutor\u2019s job in her office and her replacement, Keren Bar Menachem, had no interest in pursuing it.\u00a0 Eventually, it was closed \u201cfor lack of evidence.\u201d<\/p>\n<p>But\u00a0 Haaretz\u00a0<a href=\"https:\/\/archive.is\/20210424001446\/https:\/www.haaretz.com\/israel-news\/.premium.HIGHLIGHT.MAGAZINE-it-started-with-palestinian-s-arrest-it-ended-with-israeli-officers-probed-for-rape-1.9737766\">ran a disturbing account<\/a>\u00a0of the incident and investigation.\u00a0 Then I published Ben Ezra\u2019s name.\u00a0 I also contacted Physician for Human Rights-Israel and the\u00a0<a href=\"http:\/\/stoptorture.org.il\/?lang=en\">Public Committee Against Torture in Israel<\/a>\u00a0(PCATI), which published statements criticizing the role of the IDF physician and demanding accountability.<\/p>\n<p>Today,\u00a0 a\u00a0<a href=\"https:\/\/www.haaretz.co.il\/news\/politics\/1.9744445\">follow-up story noted<\/a>\u00a0that the PCATI statement went further,\u00a0 demanding that Attorney General Mandelblit overrule his deputy and reopen the investigation and file charges against all the Shin Bet and IDF personnel involved:<\/p>\n<p>\u201cThe fact that such a serious case was closed without indictments indicates the incompetence of police internal affairs, the military prosecutor, and the State Attorney\u2019s Office.\u00a0 They were obligated to take criminal action against all those involved in the attack. Equally serious is the fact that the case was closed because none of the suspects took responsibility, including all the senior commanders in the incident, who chose to pass the blame on to each other, as the last of the criminals. If the prosecution maintains its decision not to prosecute anyone, they should at least be fired immediately from the public service, in order to send a clear message:\u00a0<em>sexual assault, torture and war crimes are not acceptable to Israeli society<\/em>, and those [IDF and Shin Bet] commanders involved are no longer fit to serve in state institutions.\u201d<\/p>\n<p>Though the statement is laudable, it errs in one major part<strong>: the acts of which these individuals stand accused\u00a0<em>do<\/em>\u00a0represent the State<\/strong>.\u00a0 Its military and intelligence apparatus have been engaged in similar acts since the Founding of the nation; and continue them to this day.\u00a0<strong> In other words, while in some ways this act of sexual brutalization crosses boundaries in terms of heinousness; it is by no means an aberration.<\/strong><\/p>\n<p>Despite the righteous words of these NGOs,\u00a0 this does not mean that justice will be done.\u00a0\u00a0 Israeli authorities only want to look as if they are behaving appropriately.\u00a0 <strong>They do not necessarily want to actually do their jobs as they would in a genuine functioning democracy under the rule of law.<\/strong><\/p>\n<p>So Mandelblit will make a calculation whether he can get away with dropping the case; or whether the price he will pay in doing so would be too high and his reputation damaged too severely by inaction.<\/p>\n<p>So it\u2019s possible that justice will be done, though unlikely. There are almost no cases in which senior IDF or Shin Bet officers have been charged with similar crimes, let alone prosecuted and convicted.\u00a0\u00a0 But one can hope.<\/p>\n<p>I have not been able to identify the battalion commander or the IDF medical officer who played key roles in the rape.\u00a0 The physician would have been the chief medical officer for the Hebron Brigade in 2015.
