{"id":2893,"date":"2020-12-11T07:47:00","date_gmt":"2020-12-11T07:47:00","guid":{"rendered":"http:\/\/paju.org\/?p=2893"},"modified":"2020-12-10T15:51:20","modified_gmt":"2020-12-10T15:51:20","slug":"end-of-occupation-no-1035","status":"publish","type":"post","link":"https:\/\/paju.org\/fr\/end-of-occupation-no-1035\/","title":{"rendered":"\u00ab End of Occupation \u00bb No 1035"},"content":{"rendered":"<h3>A Reply to Michael Mostyn, and Canada\u2019s UN Vote<\/h3>\n<p><strong>By David Kattenberg<\/strong><\/p>\n<p>In response to 17 \u201canti-Israel\u201d resolutions routinely presented at the United Nations this time of year, the B\u2019nai Brith Canada CEO laments that Canada only voted against 16 of them. <img loading=\"lazy\" decoding=\"async\" class=\" wp-image-2890 alignright\" src=\"http:\/\/paju.org\/wp-content\/uploads\/2020\/12\/1035.jpg\" alt=\"\" width=\"200\" height=\"133\" \/>Michael Mostyn\u2019s commentary in the Dec. 3 edition of the\u00a0<em>CJR<\/em>\u00a0is both factually incorrect and disingenuous.<\/p>\n<p>Pretty solidly pro-Israel, were it not for that one \u201cyes\u201d vote affirming the Palestinian right to self-determination. That vote was \u201call the more galling,\u201d writes Mostyn, given Canada\u2019s traditional commitment to the \u201ccause of peace.\u201d<\/p>\n<p>But Mostyn quickly dismisses the idea. Israel has long recognized the Palestinian people\u2019s right to self-determination, he said, and has pitched numerous \u201cgenerous\u201d offers.<!--more--><\/p>\n<p>Really? Nothing has been more central to Benjamin Netanyahu\u2019s interminable political career than thwarting the creation of a Palestinian state. Among Netanyahu\u2019s most recent pronouncements, at a Likud conclave last summer: \u201c[In] no constellation will the government or the Knesset recognize the principle of establishing a Palestinian state.\u201d Netanyahu has said this repeatedly over the years.<\/p>\n<p>Mostyn twists it around: \u201cTragically,\u201d he wrote, \u201cthe Palestinian leadership consistently rejected [Israel\u2019s offers] because \u2013 bottom line \u2013 they refuse to accept the idea of a Jewish state.\u201d\u00a0<\/p>\n<p>This is false. The PLO accepted Israeli sovereignty on 78 percent of Palestinian lands back in 1988, in Algiers. It even acknowledged the Jewish people\u2019s ancient narrative \u2013 a huge concession, reconfirmed in the Oslo Accords, that Israel has never matched.<\/p>\n<p>Instead, under the guise of occupation, Israel has effectively annexed 60 percent of the remaining 22 percent slice, and colonized it, in breach of the UN Charter and Fourth Geneva Convention.<\/p>\n<p>Of course, Mostyn and his lobby group\u2019s lawyers fiercely deny that Israel occupies \u201cJudea\u201d and \u201cSamaria.\u201d Their theories have been debunked, and Israel\u2019s settlements have been declared unlawful in a dozen UN Security Council resolutions.<\/p>\n<p>Mostyn claims, falsely, that UN Security Council Resolutions 242 (1967) and 338 (1973) call for \u201cnegotiations between the parties to determine the status of the territories.\u201d\u00a0<\/p>\n<p>In fact, UNSC 338 called for \u201cnegotiations\u201d between the parties \u201caimed at establishing a just and durable peace.\u201d UNSC 242 affirmed the \u201cinadmissibility of the acquisition of territory by war\u201d [what Israel had just done in the 1967 Six-Day War], and the duty of UN member states to abide by Charter Articles 1 and 2, namely, the principles of \u201cjustice and international law\u201d and \u201cequal rights and self-determination of peoples.\u201d<\/p>\n<p>Neither resolution made reference to the \u201cstatus of the territories,\u201d now a matter of virtually universal consensus. Resolution 242\u00a0<em>did<\/em>\u00a0call for Israel\u2019s withdrawal from \u201cterritories occupied in the recent conflict,\u201d an inconvenient legal fact Mostyn ignores.<\/p>\n<p>Canada\u2019s policy on Palestine is clear: A) Israel is an occupying power in the West Bank, East Jerusalem, the Golan Heights and Gaza; B) Israel\u2019s settlements are illegal: and C) settlements impede the creation of a viable Palestinian state that Canada says is essential.<\/p>\n<p>But forget about Canadian policy. The UN Charter and its binding covenants\u00a0<em>oblige<\/em>\u00a0Canada to \u201crespect and ensure respect\u201d for the law in \u201call circumstance.\u201d The fact that it doesn\u2019t \u2013 that it actually\u00a0<em>invests<\/em>\u00a0in Israel\u2019s unlawful enterprise \u2013 is something Mostyn knows well but which doesn\u2019t seem to bother him at all.<\/p>\n<p>It is Israel\u2019s annexationist ambitions, not \u201cpeace\u201d policy, that Mostyn cherishes the most. According to Mostyn, Canada\u2019s vote in support of Palestinian self-determination constituted a shameful denial of the same right to the Jewish people. Here he gets to the point. \u201cAbsurdly,\u201d he writes, the lands within which Palestinians supposedly enjoy self-determination include \u201cthe holiest sites in Judaism: the Western Wall and Temple Mount, plus the Jewish Quarter of the Old City; and everything else, east to the Jordan River.\u201d<\/p>\n<p>In other words, Mostyn thinks all these lands belong to Israel, \u201cthe world\u2019s only Jewish state.\u201d He doesn\u2019t say, though clearly believes, that Jews are indigenous to these lands, and that Palestinians are not. This is what Israel thinks, and B\u2019nai Brith is Israel\u2019s \u201cstaunch defender.\u201d<\/p>\n<p>Not a very righteous stance for someone claiming to represent Canada\u2019s Jewish community, of which I am a part. He should declare himself more honestly.<\/p>\n<p><em>David Kattenburg, who lives in Winnipeg, is Jewish but doesn\u2019t consider himself indigenous to the Land of Israel. He belongs to a group called Scientists for Palestine.
