Dear Mr. Khan:<\/p>\n\n\n\n

Thank you for your initiative in seeking arrest warrants against the leaders of both sides in the carnage taking place in Gaza, Israel, the West Bank,  East Jerusalem, and the Golan Heights,<\/p>\n\n\n\n

Unfortunately, neither that initiative nor the many rulings of the International Court of Justice [Court] nor even the UNSC Resolution 2735  have resulted in any perceptible tempering of Israel’s carnage (and not only in Gaza; over 500 have been killed by Israel in the West Bank).  In both Gaza and the West Bank, Israel’s responsibility as an occupier under international law is to ensure the safety of the occupied population not to assist the settlers expand the occupation and land theft. <\/p>\n\n\n\n

Clearly , the violence will not likely cease until Israel is deprived of the stream of weapons which they receive primarily from the Unites States of America, but also from the United Kingdom, Germany, and Canada. I wish to express my sincere hope you will soon seek arrest warrants for at least one individual in each of these countries responsible for allowing military materiel to be exported to Israel. Please.<\/p>\n\n\n\n

In Canada, the Minister of Global Affairs [Minister] bears responsibility for meeting Canada\u2019s obligations as a signatory to the Arms Trade Treaty and the Convention on the Prevention and Punishment of the Crime of Genocide.<\/p>\n\n\n\n

Specifically:<\/p>\n\n\n\n

\u201cA State Party shall not authorize any transfer of conventional arms covered under Article 2 (1) or of items covered under Article 3 or Article 4, if it has knowledge at the time of authorization that the arms or items would be used in the commission of genocide, crimes against humanity, grave breaches of the Geneva Conventions of 1949, attacks directed against civilian objects or civilians protected as such, or other war crimes as defined by international agreements to which it is a Party.\u201d<\/p>\n\n\n\n

The Court has made rulings relative to the violence in Gaza. Specifically, the Court advised it was \u201cplausible\u201d Israel was committing Genocide and the Court warned other countries not to aid in the illegal occupation of Palestine by Israel.<\/p>\n\n\n\n

These two public rulings should have been sufficient to make the Minister aware of the necessity under the Arms Trade Treaty and the Convention on the Prevention and Punishment of the Crime of Genocide to stop any shipment of military materiel directly to Israel or to Israel through a third party.<\/p>\n\n\n\n

Indeed, under the terms of the Special Economic Measures Act [Act], the Minister can immediately stop all shipments of military materiel to Israel or any country. The Act states:<\/p>\n\n\n\n

\u201cThe purpose of this Act is to enable the Government of Canada to take economic measures against certain persons in circumstances where an international organization of states or association of states of which Canada is a member calls on its members to do so, a grave breach of international peace and security has occurred, gross and systematic human rights violations have been committed in a foreign state or acts of significant corruption involving a national of a foreign state have been committed.\u201d<\/p>\n\n\n\n

Certainly, the Court called upon all nations, including State Parties to the Rome Statute, to stop aiding Israel.<\/p>\n\n\n\n

Yet, Canada allows General Dynamics Ordnance and Tactical Systems Inc. to be the principal contractor on fifty thousand (50,000) M933A1 120mm High Explosive (HE) mortar cartridges with M783 fuses.  <\/em>https:\/\/www.aljazeera.com\/news\/2024\/8\/15\/how-canadas-off-the-record-arms-exports-end-up-in-israel<\/em><\/a>and https:\/\/www.readthemaple.com\/u-s-names-quebec-contractor-in-newly-approved-arms-sale-to-israel\/<\/em><\/a><\/p>\n\n\n\n

And in the United Kingdom:

Senior politicians in Israel, in the West, and in Canada have the resources to be able to know this; they have staff whose duty is to properly inform them.  Thus, the senior politicians all know, or ought to know, whether the Court determines Israel’s assault on Gaza to be a genocide, the Israeli actions are unlawful, and Israel’s continuing crimes are certainly a compounding of previous crimes against the same families.  (To be precise, according to Bloomberg about 80% of the population of Gaza are of refugee families.)<\/p>\n\n\n\n

Providing Israel with military materiel is a clear violation of international law and a travesty of humanitarian ethics.<\/p>\n\n\n\n

Mr. Khan, I believe you have sufficient evidence to seek an arrest warrant for the Honourable M\u00e9lanie Joly, the current Minister of Global Affairs. Please set the wheels in motion. If we can help, please ask us or advise us how.<\/p>\n\n\n\n
